Posted Employees
On 8 March 2016, the European
Commission proposed a revision of the
rules on posting of workers within the EU
to ensure they remain fit for purpose. The
Commission proposal was adopted on
28 June 2018.
One of the main changes introduced by the
revised Directive is that posted workers
should now receive “all the mandatory
elements of remuneration instead of the
minimum rates of pay”. The Directive
must be transposed to national laws by
30 July 2020 and cannot be applied before
that date.
Employers who violate these rates can be
charged with fines of up to €30,000 and
may be subject to prosecution because of
unethically low wages.
